These Terms and Conditions of Sale (the “Terms”) govern the sale of books through the Mouche Books website.

Mouche Books is an association-run publishing house.
These Terms apply to sales made to consumers through the Mouche Books website.
2. Products
Mouche Books sells new physical books published and/or distributed by Mouche Books.
The essential characteristics of each book are presented on its product page, including, where applicable, its title, author or authors, price, format, number of pages, ISBN and publication date.
Photographs and illustrations displayed on the website are intended to represent the products as accurately as reasonably possible. Minor differences may occur due to individual screen settings and display characteristics.
3. Prices
Book prices are displayed on the website in euros (€).
The price applicable to an order is the price displayed on the website when the customer confirms the order.
Delivery charges are shown separately before the order is finally confirmed.
Mouche Books reserves the right to change its prices at any time. Price changes do not apply to orders that have already been confirmed.
Any taxes, customs duties or import charges applicable to orders shipped outside the European Union are handled in accordance with applicable rules and the information provided at the time of the order.
4. Orders
The customer selects the books they wish to purchase and adds them to the shopping cart.
Before final confirmation, the customer may review the contents of the cart, change quantities, correct any input errors and review the total amount of the order, including applicable delivery charges.
The order becomes binding when the customer confirms the order and completes payment.
By confirming the order, the customer accepts these Terms.
An order confirmation is sent by email to the address provided by the customer.
5. No customer account required
A customer account is not required to place an order.
Customers may place orders as guests.
The customer must nevertheless provide the information necessary to process and deliver the order, including their name, delivery address and email address.
6. Payment
Payment is made exclusively by bank card through the Stripe payment service.
Payment is taken when the order is confirmed.
Payment information is processed by Stripe in accordance with its own terms and security measures. Mouche Books does not have access to the customer’s complete card details.
If payment is declined or otherwise fails, the order is not considered finally confirmed.
7. Product availability
Orders are processed subject to stock availability.
If a book becomes unavailable after an order has been confirmed, Mouche Books will inform the customer as soon as reasonably possible and, where the product cannot be supplied within a reasonable period, will refund the corresponding amounts already paid.
8. Delivery
Orders are shipped from Berlin, Germany, using Deutsche Post and/or DHL, depending on the destination and applicable shipping arrangements.
The usual processing and dispatch time is 5 business days from confirmation of the order and, where applicable, confirmation of payment.
This period refers to the usual preparation and dispatch time and does not necessarily represent the actual delivery time.
Delivery charges are fixed as follows:
- €5 for France and countries within the European Union;
- €20 for the United Kingdom;
- €20 for all other international destinations.
These delivery charges are fixed and do not vary according to the number of books ordered.
The applicable delivery charge is displayed to the customer before the order is finally confirmed.

The customer is responsible for providing a correct and complete delivery address. Mouche Books cannot be held responsible for delays or failed delivery resulting from an incorrect or incomplete address provided by the customer.

9. Orders shipped outside the European Union
Mouche Books may accept orders for delivery to countries outside the European Union.
For orders shipped to the United Kingdom and other countries outside the European Union, the fixed delivery charge is €20.
Depending on the destination country, customs duties, import taxes, customs clearance fees or other charges may be imposed by local authorities or the carrier.
These charges are not included in the delivery fees charged by Mouche Books and remain payable by the recipient, in accordance with the rules applicable in the destination country.
Customers are responsible for checking, before placing an order, any import restrictions, customs formalities or taxes applicable to the importation of books into their country.
10. Right of withdrawal
For distance contracts, consumers generally have a 14-day right of withdrawal from receipt of the goods, without having to provide a reason.
Where an order consists of several goods delivered separately, the withdrawal period begins on receipt of the last item.
To exercise the right of withdrawal, the customer must inform Mouche Books of their decision before the end of the 14-day period, by means of an unambiguous statement or the model withdrawal form provided below.

After notifying Mouche Books of the withdrawal, the customer must generally return the goods within 14 days.
Books must be returned in a condition that allows them to be resold. The customer is liable for any decrease in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Unless Mouche Books agrees to bear the return costs, the customer is responsible for the direct cost of returning the goods, in accordance with applicable law.
Where the right of withdrawal is validly exercised, Mouche Books will refund the amounts due, including the standard delivery costs initially paid by the customer, in accordance with the applicable legal requirements and deadlines.
Refunds will generally be made using the same payment method used for the original transaction.
Mouche Books may withhold the refund until the goods have been returned or until the customer has provided evidence that the goods have been sent back, whichever occurs first.
11. Statutory consumer guarantees
Books sold by Mouche Books are covered by the statutory consumer guarantees applicable under the relevant legislation, including statutory conformity and hidden-defect guarantees where applicable.
If a book is defective or does not conform to the order, the customer should contact Mouche Books at revue.mouche@gmail.com, describing the problem as precisely as possible and, where possible, providing photographs.
Nothing in these Terms limits the customer’s statutory rights.
12. Complaints
For any question, complaint or issue concerning an order, the customer may contact Mouche Books:

Mouche Books will endeavour to respond to complaints as promptly as possible and to seek an amicable resolution.
13. Personal data
Personal data required to process and deliver orders is processed in accordance with applicable data-protection legislation.
Further information regarding the processing of personal data, its purposes, the rights of data subjects and how those rights may be exercised is provided in Mouche Books’ Privacy Policy.
14. Intellectual property
Texts, photographs, images, graphics, logos, editorial content and other materials published on the Mouche Books website are protected by applicable intellectual-property laws.
Their reproduction, representation, adaptation or other use, in whole or in part, is prohibited without prior authorisation.
The purchase of a book does not grant any right to reproduce or otherwise exploit the works contained in it.
15. Applicable law and disputes
These Terms are governed by French law, subject to any mandatory consumer-protection provisions that may apply based on the consumer’s country of residence.
In the event of a dispute, the customer and Mouche Books are encouraged to seek an amicable resolution first.
If no amicable settlement is reached, the dispute may be submitted to the competent courts in accordance with the applicable jurisdiction rules.
16. Changes to these Terms
Mouche Books may amend these Terms from time to time.
The Terms applicable to an order are those accepted by the customer at the time the order is placed.
